Library Notice

Under the Copyright Ordinance, it is permissible to play or show a literary, dramatic or musical work, a sound recording, film, broadcast or cable programme without infringing copyright if the following conditions are all met:

☑ The playing is in an educational establishment;
☑ the playing is to an audience consisting wholly or mainly of teachers, pupils, their parents or guardians and other persons directly connected with the activities of the educational establishment; and
☑ the playing is for the purpose of giving or receiving instruction in a specified course of study provided by an educational establishment by a teacher or pupil or any person at the establishment.
☑ The playing is in an educational establishment;
☑ the playing is to an audience consisting wholly or mainly of teachers, pupils, their parents or guardians and other persons directly connected with the activities of the educational establishment; and
☑ the playing is for the purpose of giving or receiving instruction in a specified course of study provided by an educational establishment by a teacher or pupil or any person at the establishment.

With the “fair dealing” exemption, teachers are allowed to produce a short clip of sound or video recording (e.g. a film) and incorporate them into their teaching materials for use in a specified course of study provided by an educational establishment. The “fair dealing” exemption can also be applied by students for learning purpose as long as the relevant fair dealing criteria are fulfilled. The title of the film, the producer and the principal director must be acknowledged.
